These Terms and Conditions ("Terms") govern your access to and use of the CarTraderNG platform (the "Platform"), operated by CAR TRADER NG LIMITED ("CarTraderNG", "we", "our", or "us"), a company registered in the Federal Republic of Nigeria. By creating an account, listing a vehicle, contacting a seller, or otherwise using the Platform, you agree to be bound by these Terms.
1. The service
CarTraderNG is an online marketplace that connects private sellers and dealers with prospective buyers of used and new vehicles in Nigeria. We provide AI-assisted listing tools, document verification, and discovery features. We are not a party to any transaction between buyers and sellers, do not take possession of vehicles, and do not handle payments for vehicle sales.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under Nigerian law to use the Platform. By using CarTraderNG you confirm you meet these requirements and that the information you provide is accurate and current.
3. Accounts
You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us immediately at security@cartraderng.com if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or applicable law.
4. Listing a vehicle
When you list a vehicle on CarTraderNG you confirm that:
- You are the legal owner of the vehicle or are authorised by the owner to sell it.
- The vehicle is free from undisclosed liens, debts, or court orders.
- All photographs depict the actual vehicle you are selling.
- The vehicle particulars (VIN, mileage, year, accident history) are truthful.
- Ownership documents you upload (Customs papers, Vehicle Licence, Proof of Ownership) are genuine.
We may remove listings that are inaccurate, fraudulent, duplicate, or otherwise in breach of these Terms or Nigerian law.
5. AI verification
Our AI engine inspects photographs and reads uploaded documents to flag obvious inconsistencies and assist with fair-price estimation. AI verification is a helpful signal, not a guarantee. Buyers must still perform their own physical inspection and confirm ownership documents directly with the relevant Nigerian authority (FRSC, VIO, or the issuing state Board of Internal Revenue) before completing a purchase.
6. Buyer responsibilities
Buyers are responsible for inspecting any vehicle in person, verifying documents, and agreeing terms with the seller. CarTraderNG does not act as an escrow agent and is not liable for the condition, title, or roadworthiness of any vehicle traded through the Platform.
7. Prohibited conduct
- Listing stolen vehicles, vehicles with falsified VINs, or rolled-back odometers.
- Posting misleading photographs or doctored documents.
- Harassing, defrauding, or impersonating other users.
- Scraping the Platform or attempting to bypass security controls.
- Using the Platform to launder money or finance unlawful activity.
8. Fees
Listing a vehicle on CarTraderNG is currently free. Premium placement, dealer accounts, and verification services may be subject to fees disclosed at the point of purchase. We will notify you in advance of any change to our fees.
9. Intellectual property
The Platform, including its design, code, brand, and AI models, is owned by CarTraderNG and protected by Nigerian and international copyright law. You retain ownership of the photographs and content you upload but grant CarTraderNG a worldwide, royalty-free licence to host, display, and process that content for the purpose of operating the Platform.
10. Limitation of liability
To the maximum extent permitted by Nigerian law, CarTraderNG is not liable for any indirect, incidental, or consequential loss arising from your use of the Platform, including losses from transactions you enter into with other users. Our total liability for any direct loss is limited to fees you have paid to us in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify CarTraderNG against any claim, demand, or expense arising from your breach of these Terms, your listings, or your dealings with other users.
12. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will first be referred to good-faith negotiation, then to mediation under the Lagos Multi-Door Courthouse rules, and finally to the courts of Lagos State.
13. Changes
We may update these Terms from time to time. Material changes will be announced on the Platform at least seven (7) days before they take effect. Continued use of the Platform after that date constitutes acceptance.
